ARTICLE 1 - SCOPE AND PURPOSE

These general terms and conditions of distance selling (hereinafter "GTCS") govern the contractual relationship between, on the one hand, the shops of PAUL LUXEMBOURG network, independent franchisees of Paul Luxembourg group, represented by LUX-PAUL S.A (RCS B 166 577), located at 136, Route d'Arlon, L-1150 Luxembourg, (hereinafter "Paul Luxembourg") and, on the other hand, each customer (hereinafter the "Customer(s)") placing an order via the website at https://www.boulangerie-paul.lu.

The fact of placing a remote order with PAUL LUXEMBOURG implies unreserved acceptance of these GCS by the Client, to the exclusion of any other condition, unless PAUL LUXEMBOURG has given its prior written agreement.

PAUL LUXEMBOURG reserves the right to adapt or modify these GTC at any time without prior notice. These modifications are applicable and enforceable against the Client from the moment they are put online on the Site and apply to all subsequent orders. The version of the GTC applicable at the time the order is placed is available on the Site.

ARTICLE 2 - WEBSITE LOGIN AND ACCESS TO CUSTOMER ACCOUNT

For each order via the Site, the Customer is invited to identify himself using his Customer Account (by clicking on the « Login » or « Add to basket » links).

To this end, the Customer fills in the registration form available directly on the Site, chooses an identifier associated with a valid email address and a password. He undertakes to keep this information strictly confidential and not to communicate it to third parties, in order to avoid as far as possible any risk of intrusion into his Client Account.

PAUL LUXEMBOURG may not be held responsible for any unauthorised use of the Client Account by a third party who has had access to the identifier and the corresponding password, without fault on the part of PAUL LUXEMBOURG, and in particular if the identifier and password have been communicated to a third party by the Client or due to his negligence.

This information is by no means exhaustive and PAUL LUXEMBOURG reserves the right to request additional information from the Client. PAUL LUXEMBOURG reserves the right to refuse to open a Client account in the event of communication of manifestly incorrect data.

The Client is invited to tick if he wishes to receive communications from PAUL-Luxembourg: newsletters and communications about our activities and product and service offers.

The Customer is invited to read and accept the general terms and conditions of sale of the www.boulangerie-paul.lu website.

In the event of loss or forgetfulness of the Customer Account password, the Customer can reset the Customer Account and choose a new one by clicking on the link "Forgotten your password? "link and by entering the email address previously entered in the Customer Account.

ARTICLE 3 CLICK & DELIVERY SERVICE

3A - DELIVERY ZONES LUXEMBOURG

The Customer ordering via the website has the option to get deliveries to the office. The Client must choose from the drop-down list of buildings referenced by PAUL LUXEMBOURG. It is therefore imperative for the Client to be an employee in this building and to have access to the drop-off location.

If the building is not on the list, the customer can contact the support service via the website contact form to request the opening of the site. PAUL Luxembourg reserves the right to open the building or not depending on its location.

Please note that orders indicating a P.O. Box address cannot be taken into account.

3B - ORDER

Orders taken via the website presuppose prior registration via the creation of a PAUL LUXEMBOURG customer account (see Article 1).

(1) Delivery to the office: the Client must choose from the drop-down list of buildings referenced by PAUL LUXEMBOURG.
(2) The Site presents to the Customer the PAUL LUXEMBOURG Products available to order (hereinafter the "Products").
(3) The Customer chooses the Product(s) he wishes to order and confirms by clicking on the "Add to my basket" icon.
(4) There is no minimum charge for delivery to the office.
(5) Via the "Shopping Cart" tab, which is always accessible on the website, the Customer will find a summary of the Products chosen, their quantities and the total amount of the order and, where applicable, the delivery slot/date.
(6) Customers who have not yet logged into their Customer Account must do so in order to finalise their order.
(7) After validation of the basket, the Customer then indicates the method of payment: "Credit Card". He is redirected to a secure site administered by a secure internet payment service company, which accepts payments by Visa and Mastercard. He must then enter his card number, its expiry date and the card verification code.
(8) The Customer finally receives an email confirming his order at the email address indicated in his customer account.
(09) The order for Products is only definitively confirmed and binds PAUL LUXEMBOURG upon receipt of this email by the Customer. The Customer is therefore invited to ensure that it is received and to contact customer service by telephone or via the contact form available on our website in the event of any difficulty.

3C - BUILDING DELIVERY

The delivery of the order will take place within the building chosen by the customer. All deliveries are made within the approximate times indicated at the time of ordering on the website. The Products will be delivered according to the agreed delivery time and place. Exceeding delivery times cannot give rise to compensation.

3D - RIGHT OF REVOCATION

The Client has no right of revocation and cannot go back on his order once it has been registered by PAUL LUXEMBOURG.

3E – PRICE

The applicable prices are those in force at the time of the Customer's order, as displayed on the website. The prices displayed on the general part of the website are maximum delivered prices. The Customer will be informed of the exact price to be paid before paying his order. They are expressed in euros, all taxes included. They take into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the prices of the Products.

3F – PAYMENT

Delivery orders are payable by credit card only.

ARTICLE 4 – THE CATERING SERVICE

4A – DELIVERY ZONES LUXEMBOURG

The Customer ordering via the website is invited to choose an order to be delivered to an address in Luxembourg. The Customer must fill in his address in the fields provided for this purpose. It is therefore imperative that the address be an address known to the Luxembourg postal services.

Please note that orders indicating a P.O. Box address will not be taken into account.

4B - ORDER

Orders taken via the website presuppose prior registration via the creation of a PAUL LUXEMBOURG customer account (see Article 1).

(1) The website reminds the Customer's preference in terms of delivery.
(2) the Customer must fill in his address according to the fields provided for this purpose within the limits of the defined delivery zones (delivery zone available on the website). It is therefore imperative that the address be an address known to the Luxembourg postal services.
(3) The website presents to the Customer the PAUL LUXEMBOURG products available to order (hereinafter the "Products").
(4) The Customer chooses the Product(s) he wishes to order and confirms by clicking on the "Add to my basket" icon.
(5) A minimum amount of 50€ is imposed for home delivery.
(6) Via the "Basket" tab, which is always accessible on the website, the Customer will find a summary of the Products chosen, their quantity and the total amount of the order and the chosen delivery date.
(7) Customers who have not yet logged into their Customer Account must do so in order to finalise their order.
(8) After validation of the basket, the Customer then indicates the method of payment: "Credit card" for home delivery.
(9) The Customer is redirected to a secure site administered by a secure internet payment service company, which accepts payments by Visa and Mastercard. He must then enter his card number, its expiry date and the card verification code.
(11) The Customer receives an email confirming his order at the email address indicated in his customer area.
(12) The order for Products is only definitively confirmed and binds PAUL LUXEMBOURG upon receipt of this email by the Customer. The Customer is therefore invited to ensure that it is received and to contact customer service by telephone or by email using the contact form available on the website in the event of any difficulty (see below, article 10).

4C – DELIVERY TO THE CUSTOMER

The order will be delivered to the precise address given by the customer. All deliveries are made within the approximate time frame. The Products will be delivered according to the agreed delivery time and place.

Whenever possible, PAUL LUXEMBOURG employees and/or Couriers will warn the client by telephone of a probable delay. The absence of the Customer at his address on the date of delivery cannot give rise to a re-delivery or refund.

PAUL LUXEMBOURG employees and/or Couriers are instructed to return undelivered products.

4D – RIGHT OF REVOCATION

The Client has no right of revocation and cannot go back on his order once it has been registered by PAUL LUXEMBOURG.

(11) The order for Products is only definitively confirmed and binds PAUL LUXEMBOURG upon receipt of this email by the Customer. The Customer is therefore invited to ensure that it is received and to contact customer service by telephone or by email using the contact form available on the website in the event of any difficulty (see below, article 10).

5B - DELIVERY

ARTICLE 6 – GUARANTEES

PAUL LUXEMBOURG undertakes to ensure that the Products delivered comply with the registered order. In the event of a missing product, the Customer must inform PAUL LUXEMBOURG at the time of delivery or collection from the bakeries, no claim will be accepted after. In the event of a non-compliant product, the Customer must inform PAUL LUXEMBOURG within a reasonable period of time and at the latest within 24 hours of delivery and may request replacement of the products or reimbursement of their price.

ARTICLE 7 – LIABILITY

PAUL LUXEMBOURG may not be held liable in the event of any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown in service, external intrusion, the presence of computer viruses, fraudulent use of the bank card, etc.

PAUL LUXEMBOURG and/or the Courier will make insulated boxes available to Customers free of charge in order to better protect the products delivered against heat for a maximum period of two hours from delivery.

Under no circumstances should these boxes be used as refrigerators.

It is recommended that Customers take the delivered products out of their boxes as soon as possible and consume them immediately, otherwise place them in a refrigerator.

PAUL LUXEMBOURG and/or the courier are not responsible for any consequences whatsoever resulting from the incorrect closure of these boxes or any other failure to use them.

The products delivered are intended for consumption on the day of delivery. Surpluses cannot be kept for the following days, even in a properly functioning refrigerator. As a precautionary measure, the Company advises its Clients not to freeze delivered products that have not been consumed.

The Customer is always obliged to check the date on the label bearing his name, in order to avoid consuming products delivered a day before.

PAUL LUXEMBOURG employees and/or Couriers are instructed to throw away in the dustbin any products delivered the previous day that are still in the insulated box returned by the Customer.

The Client is not entitled to any financial compensation if he has left a product delivered the day before in the isolated box returned to the Company.

PAUL LUXEMBOURG and/or the companies linked to it, as well as their respective managers and employees, cannot be held responsible for any material, immaterial, tangible or other consequences that may result from the fact that products delivered the day before have not been thrown away whether they have been eaten or not been adequately preserved on the day of delivery.

PAUL LUXEMBOURG and/or the companies linked to it, as well as their respective managers and employees, are not responsible for any material, immaterial, bodily or other consequences that may result from allergic reactions potentially attributable to the ingestion, touch or inhalation of products delivered by it, even in the event that they have been incorrectly stored, used, handled, treated, collected, cultivated, planted, etc. by the Suppliers and/or Producers of the products used by the Company.

PAUL LUXEMBOURG and/or the companies linked to it, as well as their respective managers and employees, are not liable for any material, immaterial, tangible or other consequences that may result from the presence of foreign bodies in the goods produced by the Suppliers and/or Producers.

The content of the website and the labels have been created with the utmost care. However, it is possible that the characteristics of the products (mentions concerning allergens, nutritional values or other data) may not be presented or displayed correctly.

PAUL LUXEMBOURG invites each Client, and more particularly those subject to food allergies or intolerances, to systematically check the product characteristics indicated on the website, in addition to the information on the packaging, and to take all necessary precautions.

This limitation of liability applies in particular when information about products and their ingredients is displayed on the website. This information enables the Customer to know the content of the products with sufficient precision and to assess the inherent risks.

The production by PAUL LUXEMBOURG and/or companies linked to it of different types of sandwiches, salads, meals, soups, desserts, buffets and all other products are made in a workshop using gluten, milk, eggs, fish and shellfish, peanuts, soya, nuts, celery, mustard, sesame seeds, anhydride and sulphites, lupin and molluscs, as well as gluten products, milk, egg, fish and shellfish, peanuts, soya, nuts, celery, mustard, sesame seeds, anhydride and sulphites, lupin and molluscs.

In the aforementioned cases, PAUL LUXEMBOURG and/or companies linked to it, as well as their respective managers and employees, cannot be held responsible for the material, immaterial, bodily or other consequences that may result from allergic reactions potentially attributable to the ingestion, touch or inhalation of products delivered by PAUL LUXEMBOURG and/or Couriers.

ARTICLE 8 – CONFIDENTIALITY – PERSONAL DATA

PAUL Luxembourg is required to collect personal data transmitted via its website for the purposes of fulfilling the contract, for legitimate commercial purposes and for marketing/statistical purposes.

Paul Luxembourg may transmit personal data to third parties, in particular IT service providers, to ensure the preparation and delivery of customer orders.

In this context, all personal data that you have communicated to us is subject to the provisions of European Regulation (EU) 2016/679 of 27 April 2016.

In application of the provisions of the aforementioned regulation, the customer has at any time the right to access, rectify, erase and oblivion, limitation, portability, opposition and computerised decision. To do so, the customer simply needs to send his or her request through the contact form available on the website.
